These Terms of Service ("Terms") govern your use of the Compressly mobile application (the "App"). By downloading, installing, or using the App, you agree to these Terms.
These Terms are between you and Compressly, not Apple Inc. ("Apple"). Compressly, not Apple, is solely responsible for the App and its content, except to the extent otherwise required by applicable law or Apple's platform terms. Apple has no obligation to provide maintenance or support services for the App.
You must be at least 13 years old, or the minimum age required by applicable law in your jurisdiction, to use the App. If you are a minor, use of the App may require the involvement or consent of a parent or legal guardian.
Compressly lets you reduce the file size of videos and photos. Compression is performed on your device. Output quality, processing time, and resulting file size depend on the source media, device capabilities, settings you select, and technical limits.
A requested target file size is a goal, not a guarantee. Some files cannot be reduced to every requested size without unacceptable quality loss, incompatibility, or producing an output that is not meaningfully smaller.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded products that you own or control, as permitted by the usage rules in the Apple Media Services Terms and Conditions. Any rights not expressly granted are reserved.
The App may include free features and paid features. The exact features, limits, subscription periods, trial availability, and prices shown in the App at the time of purchase control. Paid purchases are also governed by the Purchase & Subscription Agreement.
You retain your rights in the photos and videos you process. You are responsible for ensuring that you have the right to use, process, save, or share the media you select. Compressly does not claim ownership of your media merely because you process it with the App.

The App, including its software, design, branding, and other materials supplied by us, is owned by or licensed to Compressly and is protected by applicable intellectual-property laws.
Your use of the App may also be subject to Apple Media Services Terms and other applicable Apple terms. Apple is not responsible for third-party services used by the App. Other third-party services, if included, are governed by their respective terms and policies.
Compressly is responsible for maintenance and support of the App to the extent required by applicable law. If the App fails to conform to an applicable warranty that cannot lawfully be disclaimed, you may notify Apple, and Apple may refund the purchase price for the App, if any, as provided by Apple's applicable terms. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Important — keep important originals.
Media compression may reduce quality. By default, Compressly should not replace your original file unless you explicitly choose an action that does so. You should keep backups of important originals.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT EVERY FILE CAN REACH A PARTICULAR TARGET SIZE OR THAT THE APP WILL ALWAYS BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPRESSLY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LEGALLY BE EXCLUDED.
Compressly, not Apple, is responsible for addressing claims relating to the App or your possession and use of it, including product-liability claims, claims that the App fails to conform to legal requirements, and applicable consumer-protection claims. If a third party claims that the App infringes intellectual-property rights, Compressly, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by applicable law.
You represent that you are not located in a country or region subject to a U.S. Government embargo or designated as supporting terrorism, and that you are not listed on a U.S. Government list of prohibited or restricted parties, to the extent this representation is required by Apple's minimum terms.
You may stop using the App at any time. We may suspend or terminate access to online portions of the service if you materially violate these Terms, abuse the service, or where suspension is reasonably necessary for security or legal compliance.
We may update the App or these Terms. Material changes will be reflected by updating the "Last updated" date and, where required, by providing additional notice.
These Terms are governed by the laws applicable at our principal place of business, without limiting mandatory consumer-protection rights that apply in your place of residence.
Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to provisions intended for their benefit. Upon your acceptance of these Terms, Apple has the right to enforce those provisions against you as a third-party beneficiary.
